Terms of Service

The short version

These tools help you keep records and compare what you inspected. They do not inspect anything for you. Mistakes can and will be made, the information changes constantly, and everything here is educational only. Check and validate before you decide. Passes are one off payments that simply expire, nothing renews and nothing is charged again. All payments are final and we do not give refunds, apart from what the Australian Consumer Law requires. Your notes and photos stay yours. Be decent, do not attack the service, and do not resell it.

The numbered clauses below are the actual agreement. The plain English above is a summary, not a substitute.

1. Who we are

EveryVerdict and its products, including VanVerdict and Car Verdict, are operated by Dutch Digital Dynamics Pty Limited (ABN 86 081 237 087), based in Queensland, Australia. In these terms, "we", "us" and "our" mean that company. "You" means the person using the service.

These terms apply to every EveryVerdict website and app, including everyverdict.com, everyverdict.com.au, vanverdict.com and car.everyverdict.com, and to any associated or linked property we operate.

2. Accepting these terms

You must tick the agreement box when you create an account or start a free trial. By ticking it you confirm you have read and agree to these terms, the Privacy Policy, the Refund Policy and the Disclaimer. We record that you accepted, which version you accepted, and when. If you do not agree, do not use the service.

You must be at least 18 years old and legally able to enter a contract.

3. What the service is, and what it is not

EveryVerdict products are record keeping and comparison tools. You capture notes, photos, voice notes, documents and structured checklist answers about caravans, cars or other items you are considering, and the app organises that material and lays your options side by side.

The service is not an inspection, a valuation, a mechanical or structural or gas or electrical or compliance assessment, a roadworthy certificate, a history check, or finance, insurance, legal or tax advice. We never physically examine your caravan or vehicle.

4. Use at your own risk, and the educational purpose

This clause matters more than any other, so read it properly.

5. Your account

You are responsible for keeping your password and any two factor codes secure, and for everything done under your account. Give us accurate details, including a working email address, because that is how we send receipts, expiry notices and security messages. Tell us promptly if you think someone else has access.

One account is for one person. Where a pass includes a partner account, that is for one additional person in your household, not for sharing around.

6. Free use and paid passes

You can use the service free, with a limit on how many items you can record and with some features held back. Free use is provided as is and we may change its limits.

Paid passes are one off payments for a fixed period. There is no subscription. Nothing automatically renews and we do not store your card to charge you again. When a pass reaches its end date your account moves to a read only archive state: your records stay there and stay exportable, you simply cannot add new ones until you buy another pass.

Current pass types, prices and durations are published on the pricing page, which forms part of these terms. Prices are in Australian dollars and include GST where GST applies. We may change prices at any time, but never for a pass you have already bought.

Payments are processed by Stripe. We do not see or store your full card details. Your purchase is also subject to Stripe's own terms.

No refunds. All payments are final. We do not refund a pass, in whole or in part, for a change of mind, for time you did not use, for a purchase made by accident or on the wrong account, or when an account is closed or a product is changed or discontinued. Billing mistakes, such as a double charge, are fixed by adding pass time to your account, not by returning money. The only exception is a remedy the Australian Consumer Law gives you that cannot be excluded, see clause 10. The Refund Policy sets this out in full and forms part of these terms.

7. Your content

Your notes, photos, voice notes, documents and checklist answers remain yours. We claim no ownership of them.

You give us the limited permission we need to run the service for you: to store your content, sync it between your devices, process it to produce the features you asked for including comparisons and any AI assisted research you trigger, back it up, and display it back to you and to a partner account you have linked. That permission lasts while your account exists and ends when your content is deleted, apart from copies sitting in routine backups until those backups age out.

You confirm you have the right to upload what you upload. Do not upload material that infringes someone else's rights, and be mindful when photographing people, private property or dealer premises. We may use de identified, aggregated information to improve the service.

You can export your records at any time from inside the app, and we recommend you do so before a pass expires.

We work to keep the service available and correct, but we do not promise it will be uninterrupted, error free or permanently available. We may change, add or remove features, and we may carry out maintenance. Where a change is significant we will give you reasonable notice by email or in the app.

The app is designed to work offline and sync when a connection returns. Sync depends on your device and network, and you remain responsible for keeping your own copies of anything you cannot afford to lose. Exporting your records regularly is the sensible habit.

We are not responsible for third party services we rely on or link to, including Stripe, email delivery, mapping, AI providers, dealers, manufacturers and government services.

10. Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Our services come with consumer guarantees that cannot be excluded, and if we fail to meet one you may be entitled to a remedy.

Subject to that, and to the maximum extent the law allows:

You agree to indemnify us against claims arising from your misuse of the service, your breach of these terms, or content you uploaded that you did not have the right to upload.

11. Suspension and ending things

You can stop using the service at any time and ask us to close your account by emailing support@everyverdict.com. Closing your account does not refund any part of an unexpired pass, see the Refund Policy.

We may suspend or close your account if you materially breach these terms, if your use threatens the security or stability of the service, or if we are required to by law. Where the circumstances allow it we will tell you first and give you a chance to fix the problem, and we will give you a reasonable opportunity to export your records.

We may also discontinue a product. If we do, we will give reasonable notice, and let you export everything. Discontinuing a product does not give rise to a refund of any unused pass time, except where the Australian Consumer Law requires one.

12. Privacy

How we handle your personal information is set out in the Privacy Policy, which forms part of these terms.

13. Changes to these terms

We may update these terms. The version number and date at the top show which version applies. For material changes we will give you notice by email or in the app before they take effect, and we may ask you to accept the new version. Continuing to use the service after a change takes effect means you accept it. If you do not accept a material change, stop using the service. A change to these terms does not give rise to a refund.

14. General

These terms, together with the Privacy Policy, Refund Policy, Disclaimer and pricing page, are the whole agreement between us about the service. If a clause is unenforceable it is severed and the rest stands. Our not enforcing a right straight away does not waive it. You may not transfer your rights under these terms without our consent.

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
